The problem of the effectiveness of the rights recognized for women is not new. Its existence is attributed to very early years. After several analyses, we were able to note that the protocol to the African Charter on Human and Peoples’ Rights, relating to the rights of Women in Africa, greatly prioritized women’s rights. Certain laws in the DRC have not remained unanimous on this subject. However, the Constitution recognizes the rights and freedoms of all Congolese citizens. In addition, the Vienna Declaration and Program of Action adopted on June 25, 1993 by the World Conference on Human Rights; aims to strengthen the determination of the international community with a view to achieving significant progress in action in favor of human rights through an increased and sustained effort of international cooperation and solidarity. Here we must see in particular articles 36 to 44 which deal with equality of condition and fundamental rights of women.

Abstract

La problématique de l’effectivité des droits reconnus à la femme n’est pas nouvelle. Son existence est attribuée aux années très reculées. Après plusieurs analyses, nous avons pu constater que le protocole à la Charte Africaine des droits de l’Homme et des peuples, relatifs aux droits des Femmes en Afrique ont beaucoup privilégié les droits des femmes. Certaines lois de la RDC ne sont pas restées unanimes à ce sujet. Cependant, la Constitution reconnait les droits et libertés à tous les citoyens Congolais. En sus, la Déclaration et le programme d’action de vienne adoptée le 25 juin 1993 par la Conférence mondiale sur les droits de l’homme; a pour but de renforcer la détermination de la communauté internationale en vue de la réalisation de progrès sensibles dans l’action menée en faveur des droits de l’Homme grâce à un effort accru et soutenu de coopération et solidarité internationale. Il faut ici voir plus particulièrement les articles 36 à 44 qui traitent de l’égalité de condition et des droits fondamentaux de la femme.
