The present work aims to study the legal instruments of the Democratic Republic of Congo on the management of chemicals to assess the level of their implementation. This descriptive study covered 31 legal texts, including the Constitution of the Republic, an ordinance-law, eight laws, a framework law, seven ordinances, seven decrees, six decrees and 21 international conventions. The results of the analyzes from the inventory of legal texts show that the country suffers from a problem of the implementation of these different legal texts in the management of chemicals. Thus, for rational management of these products in DR Congo, state authority in control over the life cycle of chemicals (from import to waste management) should be strengthened and a regulatory authority.

Le présent travail s’est fixé pour objectif d’étudier les instruments juridiques de la République Démocratique du Congo sur la gestion des produits chimiques afin d’apprécier le niveau de leur mise en application. Cette étude de type descriptif a porté sur 31 textes juridiques dont la Constitution de la République, une Ordonnance-loi, huit lois, une loi cadre, sept ordonnance, sept décrets, six arrêtés et 21 conventions internationales. Les résultats des analyses issus de l’inventaire des textes juridiques montrent que le pays souffre d’un problème de la mise en application de ces différents textes juridiques dans la gestion des produits chimiques. Ainsi, pour une gestion rationnelle de ces produits en RD Congo, il faudrait renforcer l’autorité de l’Etat dans le contrôle de tout le cycle de vie des produits chimiques (de l’importation à la gestion des déchets) et créer une autorité de régulation.
