Since the establishment of the military courts in DR Congo by the colonial legislator by decree from December 22, 1888 until February 18, 2006, date of the promulgation of the Constitutions of the Third Republic, the Officer of the Military Public Ministry remained regulatory body for preventive detention and the setting in motion of public action. To say that there are absences from the procedure of the direct summons as mode of seizure of the military jurisdictions and absence of the chamber of advice required for a suitable justice. The recognition of the procedures mentioned above remains a prerequisite for the proper administration of Congolese military justice.

Abstract

Depuis l’institution des juridictions militaires en RD Congo par le législateur colonial par décret du 22 décembre 1888 jusque le 18 février 2006, date de la promulgation de la Constitutions de la IIIème République, l’Officier du Ministère Public militaire est resté l’organe régulateur de la détention préventive et de la mise en mouvement de l’action publique. Pour dire qu’il y a absences de la procédure de la citation directe comme mode de saisine des juridictions militaires et absence de la chambre de conseil exigée pour une justice convenable. La reconnaissance des procédures ci-évoquées demeure un préalable pour la bonne administration de la justice militaire Congolaise.
