Since gaining independence, the Democratic Republic of Congo has experienced many problems; among other things the legal problem and particularly the 50 years spent in civil wars have made it a vast site of juvenile delinquency. Many laws have been passed and promulgated, but they seem to be insufficient to stem all the problems linked to delinquent children or to children victims of delinquency and deviance. It should be noted that since the entry into force of the law n ° 09/001 of January 10, 2009 on the protection of the child and the installation of the juvenile court, the legal conditions of children in conflict with the law seem to be to improve, now delinquent children are no longer tried in the same court as adults. However, in the juvenile court the appeals chamber has not yet been set up due to the lack of judges. This is how a decision rendered in the First Chamber cannot be reformed by the review procedure, which is the sole responsibility of the judge who issued a first decision to review it. The consequences of the double degree of jurisdiction before the tribunal of children are by filing an appeal on the same jurisdiction with the same judge there is not too much reliability in judgments contradiction.

Depuis son accession à l’indépendance, la République Démocratique du Congo connaissait plusieurs de problèmes; entre autre le problème juridiques et particulièrement les 50 ans passés dans les guerres civiles en ont fait un vaste chantier de délinquances juvéniles.De multiples lois, ont été votées et promulguées, mais, elles semblent être insuffisantes pour endiguer l’ensemble des problèmes liés à l’enfance délinquante ou à l’enfance victime de délinquance et de déviance.Il faut noter que depuis l’entrée en vigueur de la loi n°09/001 du 10 janvier 2009 portant protection de l’enfant et l’installation du tribunal pour enfant, les conditions judiciaires des enfants en conflit avec la loi semblent s’améliorer, désormais les enfants délinquants ne sont plus jugés au même tribunal que les majeurs.Cependant au tribunal pour enfants de Kisangani, la chambre d’appel n’est pas encore installée à cause de la carence des juges. C’est ainsi que pour une décision rendue à la première chambre n’est peut être réformé par la procédure de la révision qui revient au seul juge qui a rendu une première décision d’en revoir. Les conséquences du double degré de juridiction devant le Tribunal de Grande Instance sont en interjetant l’appel sur une même juridiction avec un même juge il n’y a pas trop de fiabilité sur la décision, la contradictoire de la décision.
